    These Patient Terms & Conditions (“Terms”) govern the access and use of the Live Gracious Platform (“Platform”) by users/patients (“Users”).

    1. Acceptance of Terms

    1.1 By using the Platform, you agree to comply with these Terms and all applicable laws.

    1.2 If you do not agree, you must not access or use the Platform.

    2. Definitions

    • “Platform” means Live Gracious digital health platform including consultations, EMR access, community, and insights.
    • “Patient / User” means Individual seeking healthcare services.
    • “Healthcare Provider” means Licensed medical professional listed on the Platform.
    • “Services” means features such as booking consultations, secure communication, access to prescriptions/records/care plans, health insights, and community features.

    3. Eligibility and Registration

    • 3.1 Users must be 18 years of age to register and use the Platform independently.
    • 3.2 Minors may access services only through a parent/guardian and under their supervision and consent.
    • 3.3 Users must provide accurate, complete, and updated information during registration and usage.
    • 3.4 Users are responsible for keeping login credentials confidential and must notify Live Gracious in case of unauthorized access.

    4. Role of the Platform

    • 4.1 Live Gracious is a technology platform that facilitates access to healthcare-related services.
    • 4.2 Live Gracious does not provide medical advice, diagnosis, prescriptions, or treatment.
    • 4.3 All consultations, prescriptions, treatment plans, and clinical decisions are provided solely by licensed healthcare providers.
    • 4.4 Live Gracious is not responsible for medical outcomes, treatment decisions, side effects, complications, or Provider conduct.

    5. Services for Patients

    The Platform enables patients to:

    • Book, reschedule, and manage consultations.
    • Communicate securely with healthcare providers.
    • Access prescriptions, reports, care plans, and medical summaries.
    • Receive assistive and personalized health insights.
    • Participate in optional community features.

    6. Consent and Data Use

    • 6.1 By using the Platform, patients consent to the collecting and processing of your personal and health-related data in accordance with the Platform’s Privacy Policy and in-app consent settings.
    • 6.2 Users may withdraw consent for non-essential features at any time through available settings (where applicable).
    • 6.3 Certain information may be retained to comply with legal, regulatory, medical, or audit requirements.
    • 6.4 Users must not share another person’s medical information without lawful authority, consent, or guardianship rights.

    7. Referrals and Continuity of Care

    • 7.1 Users may choose to share medical records with other healthcare providers on the Platform for referrals or second opinions, subject to explicit consent.
    • 7.2 Users understand that continuity of care depends on record accuracy and timely disclosure of medical history, ongoing medicines, and allergies.

    8. Community Features

    8.1 Community participation is optional and intended for peer support and education only.

    8.2 Community content does not constitute medical advice, diagnosis, or treatment.

    8.3 Users agree not to post:

    8.4 Live Gracious may remove any content and restrict access to the Community without prior notice if it violates these Terms or applicable law.

    • Abusive, defamatory, hateful, misleading, or unlawful content.
    • Medical misinformation.
    • Personal sensitive details of themselves or others (phone numbers, addresses, medical reports, etc.).
    • Promotional/spam/scam content.

    9. Appointments, Payments, and Cancellations

    • Consultation fees are determined and set by healthcare providers.
    • Payments (where applicable) must be completed before the consultations starts.
    • Cancellation and refund policies are displayed at the time of booking and are binding once accepted.
    • Refund timelines may vary based on the payment gateway, bank processing, and applicable prices.
    • Live Gracious may charge platform convenience fees or payment gateway fees as disclosed at the time of payment (if applicable).

    10. User Responsibilities

    Patients agree to:

    • Provide accurate and complete medical and personal information.
    • Use the Platform only for lawful purposes.
    • Respect the privacy of other users.
    • Follow prescribed treatment plans and medical instructions.
    • Not impersonate another person or attempt fraudulent access.
    • Not record, store, or share consultations or calls without prior consent of the Provider and compliance with applicable law.

    11. Emergency Disclaimer

    11.1 The Platform is not intended for medical emergencies.

    11.2 In emergencies, user must seek immediate in-person medical care and/or contact local emergency services.

    12. Limitation of Liability

    12.1 Live Gracious is not responsible for:

    12.2 Live Gracious’ liability (if any) shall be limited to the fees paid by the User for Platform services (excluding Provider fees), for the relevant transaction/period.

    12.3 Live Gracious shall not be liable for indirect or consequential losses including loss of opportunity, loss of profits, or reputation damage.

    • Clinical decisions, prescriptions, diagnosis, or treatment outcomes.
    • Acts or omissions negligence, or misconduct of healthcare providers.
    • Delays, disruptions, or technical issues beyond reasonable control.

    13. Termination

    • 13.1 User may terminate their account at any time.
    • 13.2 Medical and transaction records may be retained as required by law and regulatory guidelines.
    • 13.3 Live Gracious may suspend or terminate accounts for misuse, fraud, illegal activity, harassment, or breach of these Terms.

    14. Governing Law and Jurisdiction

    These Terms are governed by the laws of India. Courts at Nagpur, Maharashtra shall have jurisdiction.

    15. Modifications

    Live Gracious may update these Terms with prior notice. Continued use of the Platform constitutes acceptance of the updated Terms.

    17.3 Resolution Timeline

    • a) Live Gracious will acknowledge receipt of the complaint within 48 hours.
    • b) Live Gracious will take reasonable steps to resolve the complaint within 15 (fifteen) working days, depending on the nature of the grievance.

    17.4 User Cooperation

    Users agree to cooperate and provide relevant details/documents required for grievance resolution.

    18. Force Majeure

    18.1 Live Gracious shall not be liable for any failure, delay, interruption, or disruption in performance of its obligations under these Terms due to events beyond its reasonable control (“Force Majeure”), including but not limited to:

    18.2 During a Force Majeure event, Live Gracious may suspend or restrict Platform access temporarily, and shall resume services as soon as reasonably possible.

    • Acts of God, fire, flood, earthquake.
    • War, riots, civil unrest.
    • Government orders, restrictions or lockdowns.
    • Telecom/internet failure, power outage.
    • Cyberattacks, hacking incidents, server failure.
    • Third-party service interruptions (including payment gateway issues).

    19. Severability

    If any provision of these Terms is deemed invalid or unenforceable, remaining provisions shall continue in full force and effect.

    20. Acknowledgment

    By using the Live Gracious Platform, users acknowledge they have read, understood, and agree to be bound by these Terms & Conditions.

    These Terms & Conditions are effective as of 22-Jan-2026 and govern your use of the Live Gracious Platform.
